The Chief Justice of India TS Thakur on Tuesday dismissed a review petition filed by the Board of Control for Cricket in India asking the Supreme Court to recall its verdict approving the Justice RM Lodha reforms.
The Apex Court meanwhile postponed the hearing on the BCCI-Lodha matter to Thursday.
“We have examined the grounds urged in support of the prayer for review. We find no error apparent on the face of the record to warrant recall of our order dated July 18, 2016. The review petitions are, accordingly, dismissed,” a bench of Chief Justice T S Thakur and Justice SA Bobde were quoted as saying by PTI.
While filing the review petition, the BCCI had contended that the “judgment was unreasoned and seeks to frame legislative measures for a private autonomous society in a field already occupied by legislations, both parliamentary and state”.
However, after the dismissal, the BCCI now has an option of seeking a curative petition as it has previously stated that the judgment “neither noted the contentions and facts correctly, nor dealt with the same.”
The BCCI is opposing few clauses of the Lodha reforms that include age and tenure caps for top officials and one-state-one-vote.
