The Board of Control for Cricket in India filed a petition in the Supreme Court on Tuesday, seeking a review of the court's earlier verdict in July where the cricket body was given six months to implement the Lodha panel's recommendations, according to PTI.
The cricket body has also asked for a recusal of the Chief Justice of India TS Thakur from hearing the petition as it contended that there had been a "prejudiced approach" against it.
"Chief Justice TS Thakur seems to have a prejudiced approach to BCCI which is evident by statements such as 'BCCI treatment' is to be meted out to another entity, i.e. the All India Football Federation in another case, ex-facie shows that the Chief Justice has a closed mind and will summarily dismiss the review petition without listing the same before another bench of five judges for hearing in the open Court," said the petition.The BCCI also called the earlier judgement "unreasoned" and argued that it sought to frame legislative measures for a private autonomous society.
"The judgment is unconstitutional and contrary to many binding precedents of this Court and adversely affects and nullifies the fundamental rights granted to citizens under Article 19(1)(c) of the Constitution, " said the petition.
In its verdict on July 18, the Supreme Court had called on the BCCI to implement the Justice Lodha committee's recommendations in six months and later in August, given the body, time till October 15 to comply with 15 constitutional reforms. Former Supreme Court judge Markandey Katju, who was recently appointed the head of a BCCI legal panel, had criticised the top court's order as "illegal and unconstitutional".
